The following Product Terms apply to debit card services provided by Bank Partner to Client as set forth in the Covered Banking Services section of the Banking Services Agreement (collectively, the “Debit Card Services”). These Product Terms are governed by, and incorporated by reference into, the Banking Services Agreement. Capitalized terms not otherwise defined herein are ascribed the same meaning as set forth in the Banking Services Agreement.
1.1 Debit Card Services; Debit Cards. If applicable, Bank Partner will provide the Debit Card Services as set forth in these Product Terms and the BSA, including the issuance of debit cards (“Debit Cards”) to End Users associated with the Client. A Debit Card is the access device by which an End User may make a Debit Card transaction, as set forth below. The Debit Cards may be issued physically or virtually. The End User will have access via the Debit Card to the End Users’ applicable and available funds. Such funds may be held in an Account in the End User’s name or in an account for which the End User is an authorized user or permitted cardholder. Bank Partner will sponsor a unique BIN range which Bank Partner and Unit will use to facilitate the issuance of the Debit Cards for use within the applicable network. If Client permits End Users to designate authorized users or permitted cardholders who are authorized to access such End User’s Account, the term “End User” includes such authorized users or permitted cardholders for purposes of these Product Terms.
1.2 Debit Card Transactions. Subject to Client’s and End User’s compliance with the terms of all applicable agreements with Bank Partner, including without limitation, the Banking Services Agreement and End User Documentation, as applicable, End Users may use Debit Cards for the following types of Debit Card transactions:
(a) to make a purchase;
(b) to obtain a credit for a previous purchase;
(c) to withdraw funds from and, where applicable, deposit funds in a terminal or automated teller machine (ATM);
(d) to make a bill payment or other payment to a third party;
(e) to deposit funds to an account;
(f) to facilitate push to Debit Card transactions; or
(g) without duplication of any of the foregoing, any other permitted transaction involving use of a Debit Card.
1.3 Settlement. Debit Card transactions will be settled using the End User’s funds in accordance with the Network Rules.
1.4 PCI DSS. To the extent applicable to Client, Client will comply with all applicable data privacy and security requirements under the Payment Card Industry Data Security Standards (“PCI DSS”). If applicable, upon Bank Partner’s or Unit’s request, Client will provide documentation demonstrating Client’s PCI DSS compliance. If Client is required to be PCI DSS compliant and is not PCI DSS compliant, Bank Partner or Unit may suspend the Platform Services. Unless otherwise required by Applicable Law or a Governmental Authority or determined by Bank Partner in its discretion, Bank Partner and Unit shall provide Client with thirty (30) days after providing notice to Client to become compliant before enacting such suspension.
